Another great auction for the School Board of Sarasota County, Florida on May 20th, 2017! We'll also have online absentee bidding available for those who can't make it, but you'll want to see this one in person! Come spend the day with us for some amazing deals! This is an early notice, and we'll be adding more information soon- but for now we know we'll have 23 School Buses, with 15 of them being the newer style 2006 Thomas/Freighliner 77 Passengers with the Mercedes Engine! IMPORTANT: PLEASE READ - BY PLACING ANY BIDS YOU AGREE TO THE FOLLOWING: Any additional terms listed in the auction or lot description(s) also apply. ABSENTEE BID DEPOSITS and PAYMENT: Please note if any of your absentee bids are the highest when absentee bidding is closed, your credit card on file will be charged 25% of your bid(s) before the start of the auction. If your card is declined, your bids will not be placed. Absentee bidding is provided as a courtesy and while we will make every effort to bid on your behalf, we cannot be responsible for missed bids for any reason. If you do not win any items, your deposit will be returned in full. If you win any items, your card on file will be charged Saturday evening for the total invoice (bids, buyer's premium and sales tax) unless payment is made at the auction site by 3pm or 1 hour after the last item sold, whichever is later. Additional Absentee Bidding Terms will be added and applicable to absentee bids. ALWAYS check terms for each auction as each auction may have different terms (shipping options, pickup locations/times, etc.) All items are sold "As-Is, Where-Is" with no warranty or claim of merchantability or fitness for a particular purpose. Buyer is solely responsible for previewing items and determination of condition and value. We are not experts on any particular items and provide descriptions only as a courtesy. Buyer's Premium: 15%. Buyer's Premium is included in the total purchase price and therefore subject to any applicable sales tax. Sales Tax: 7% for Local Pickup, No tax on items shipped out of Florida or on purchased by buyers providing a FLORIDA Sales Tax Exemption Certificate BEFORE auction ends. Vehicle sales taxes will be based on the county of the address listed on the invoice and title. You agree to pay for all of your successful bids plus buyer's premium, sales tax (if applicable) and any other associated fees outlined in the terms as well as the auction and lot descriptions, including storage fees if items are not removed by the stated removal deadline. Preview: 7:30-8:30 AM the morning of the auction, Saturday, May 20th, 2017. Shipping & Pickups ***This section is specific to this auction only***: THERE IS NO SHIPPING OFFERED FOR THIS AUCTION. Items MUST be picked up in person during stated removal times. If sending a freight or pack and ship company to pick up your items, you MUST ensure they bring a copy of your PAID IN FULL invoice. We will not charge storage for items not removed, but items will be considered abandoned at the end of the last pickup window. Abandoned items will be disposed of or resold at our discretion without compensation to the buyer. Non-paying bidders will be banned from our auctions, and we reserve the right to share this information with other auctioneers directly and/or through our auction platform, and that information may be used to prevent you from bidding on their auctions as well. Registration: You must be at least 18 years old to bid Registration for on-site bidders will be in-person the morning of the auction. You will only need to register online if you would like to place absentee bids. YOU MUST REGISTER for online absentee bidding for each auction. Once you have set up your HiBid account, you will not have to re-enter your information each time. You must provide a valid credit card. The card you submit when registering for each auction will be charged at the conclusion of that auction unless you notify us before the end of the auction that you would like to pay in person. In-person or phone payments must be made within 1 hour of auction end or card on file will be charged. In the event that payment is not made and credit card is declined, buyer will be responsible for collection costs, storage fees (see above), court costs and/or attorney's fees as needed in order to collect payment. Tie Online Bids: In the event of identical bid amounts from multiple bidders, the earlier bid will take precedence. All Items Selling "as is, where is." All Sales are Final - No Refunds! You are bidding ONLY on the item(s) as described in the Online Catalog and NOT as the lot seems to appear in photograph(s). Buyer is solely responsible for inspection and determination of value. Once an item is called sold it will immediately become the responsibility of the buyer. We cannot be held liable for any damage or theft of the item. You are responsible for all costs associated with removal and any damage to the Auction site or other items, as well as providing the necessary boxes, packing materials, equipment and labor necessary to safely remove your items. No item will be released without a PAID-in-FULL invoice listing the item(s) purchased. The Auctioneer's decision on all disputes and related matters is final. Both Auctioneer and Seller reserve the right to make changes to and/or remove any lot(s), prior to the Auction closing. Auctioneer and Seller liability shall be limited to the return of any monies paid by the Buyer. All Bidders agree to indemnify and hold harmless the Auctioneer and Seller, their agents and representatives, from and against all liability, claims, suits or causes of action from participation in, purchase and/or removal of items at this Auction. All disputes that may arise by virtue of and/or under the contractual relationship by and between the parties to this agreement will be governed by the laws of the State of Florida. The venue of any legal action that may arise between the parties to these agreements and/or the auction proceedings conducted by Florida Surplus Auctions will be in Santa Rosa County, Florida. Any cause of action and/or suit of any kind arising between the parties hereto (to include auctioneer, auction company, consignor or purchasers of goods at auction) must be commenced within one (1) year from the date the cause of action accrues or it will be forever barred. The right of action or suit will accrue and the one (1) year limitation period will begin to run, on the date of the breach, damage or injury is sustained and not when the resulting cost, damage, harm or loss is discovered. Payment is due within 1 hour of the last item sold. Payment by Cash, Bank Check, Bank Wire or Major Credit Card. 15% Buyer's Premium applies to all invoices regardless of payment method.
Pickup is at School Board of Sarasota County Warehouse, 101 Old Venice Rd., Osprey, FL 34229 until 3pm the day of the auction and/or as announced. If you are unable to pick up your items on the day of the auction, you may make an appointment to pick up items on Monday, May 22nd between the hours of 9am and 2pm. Items left after 2pm Monday, May 22nd are forfeited without compensation or refund. Neither the seller nor auctioneer is responsible for items once sold. No assistance will be available beyond forklift assistance for pallets - you must provide you own loading / packing materials and labor as needed.
