September 17th, 2016 in Green Cove Springs, Florida we will be auctioning vehicles, heavy equipment and assorted other items for the Clay County Board of County Commissioners and the Clay County Sherriff's Office. This will be a live, on-site auction with webcast bidding. Items will include County, Police and Confiscated Cars, SUV's, Trucks and Vans as well as Bucket Trucks, a Dump Truck, Backhoe, Tractor, Box Blade, Bat-Wing Mower and assorted lawn, maintenance and food service equipment. IMPORTANT: PLEASE READ - BY PLACING ANY BIDS YOU AGREE TO THE FOLLOWING: Any additional terms listed in the auction or lot description(s) also apply. The following changes to our standard terms apply to this auction only: -There is no Buyer's Premium for this auction. -Bid Increments listed apply to online bidding only and will be adjusted to match the live auction in realtime. -There will be a 4% Surcharge for Credit Card Payments -Sales Tax in Clay County is 7%, Titled Vehicles will be taxed based on county to be titled/registered in. -Internet Bidders will be charged a $100 (not to exceed purchase price) per vehicle non-refundable deposit once an item is won (up to a $500 maximum deposit per buyer). This will be charged to the card used when registering for the auction. The card CANNOT be changed after registration, so please be sure your preferred card is on file at the time of registration. If the deposit charge is declined, the buyer will be blocked from bidding and the item resold. Dealers and others planning on purchasing multiple vehicles may contact us by Wednesday, September 14th to make alternate deposit arrangements -Payment in Full the day of the sale. All purchases must be paid in full by noon on Monday, September 19th or all deposit monies will be forfeited. Payments made on Sunday or Monday must be made by bank check, wire or credit card only (cash only accepted on auction day). No titles or keys will be issued, or items removed until payment has been made in full. -Payment is by Cash, Bank Check, Wire or Credit Card (4% Surcharge for Credit Cards). Business or Personal Checks are ONLY accepted with a Bank Letter of Guarantee - NO EXCEPTIONS. Letter must guarantee up to a specific amount, payable to Florida Surplus Auction, and reference Clay County Auction 9/17/2016. Letters of good standing or account balance WILL NOT BE ACCEPTED. -Deadline to remove purchases is 3pm on Monday September 19th. Any titled items left after the deadline are subject to towing, storage and impound fees. Any non-titled items left after the deadline will be considered abandoned and may be resold or disposed at the auctioneer's and seller's discretion. -Online bidding is provided as a courtesy to buyers who cannot attend the live auction. We do not guarantee the service or your connection to the service. Preview: Items may be previewed at the auction site 2 hours before the start of the auction, additional preview day(s) and time(s) to be announced. Shipping & Pickups: Shipping is not offered for this auction. Non-paying bidders will be banned from our auctions, and we reserve the right to share this information with other auctioneers directly and/or through our auction platform, and that information may be used to prevent you from bidding on their auctions as well. You must be at least 18 years old to bid YOU MUST REGISTER for online bidding for each auction. Once you have set up your HiBid account, you will not have to re-enter your information each time. You must provide a valid credit card. The card you submit when registering for each auction will be charged at the conclusion of that auction unless you notify us before the end of the auction that you would like to pay in person. In-person or phone payments must be made within 24 hours of auction end or card on file will be charged. In the event that payment is not made and credit card is declined, buyer will be responsible for collection costs, storage fees (see above), court costs and/or attorney's fees as needed in order to collect payment. Once an item is called sold it will immediately become the responsibility of the buyer. We cannot be held liable for any damage or theft of the item. You are responsible for all costs associated with removal and any damage to the Auction site or other items, as well as providing the necessary boxes, packing materials, equipment and labor necessary to safely remove your items. No item will be released without a PAID-in-FULL invoice listing the item(s) purchased. If you are Outbid, you may receive an e-mailed notice. These notices are not sent in the closing minutes of the auction. Auctioneer is not responsible for delayed and/or undelivered e-mails. The Auctioneer's decision on all disputes and related matters is final. Both Auctioneer and Seller reserve the right to make changes to and/or remove any lot(s), prior to the Auction closing. Auctioneer and Seller liability shall be limited to the return of any monies paid by the Buyer. All disputes that may arise by virtue of and/or under the contractual relationship by and between the parties to this agreement will be governed by the laws of the State of Florida. The venue of any legal action that may arise between the parties to these agreements and/or the auction proceedings conducted by Florida Surplus Auctions will be in Santa Rosa County, Florida. Any cause of action and/or suit of any kind arising between the parties hereto (to include auctioneer, auction company, consignor or purchasers of goods at auction) must be commenced within one (1) year from the date the cause of action accrues or it will be forever barred. The right of action or suit will accrue and the one (1) year limitation period will begin to run, on the date of the breach, damage or injury is sustained and not when the resulting cost, damage, harm or loss is discovered.
